1. About Growth Tech

Growth Tech is a digital marketing and website development agency based in Surat, Gujarat, India.

Growth Tech provides digital services to businesses, professionals, organisations and other customers according to the scope agreed for each project or service.

The exact legal entity, contracting party and commercial terms applicable to a particular engagement may be identified in the relevant quotation, invoice, proposal or service agreement.

Each project or service is governed primarily by the scope described in the applicable quotation, proposal, invoice, statement of work or service agreement.

Services, features, pages, revisions, integrations, deliverables and timelines that are not expressly included in the agreed scope should not be assumed to be included.

4. Quotations & Proposals

Quotations and proposals are prepared based on the information and requirements available at the time they are issued.

A quotation may specify the project scope, price, taxes, payment schedule, timeline, deliverables, revisions, third-party costs and other applicable conditions.

Unless specifically stated otherwise, a quotation does not automatically include services, features or expenses that are not listed in it.

5. Project Acceptance

A project or service may be considered accepted when the client approves the quotation, proposal or scope of work, makes the required payment, provides written confirmation, electronically communicates acceptance or otherwise instructs Growth Tech to commence the agreed work.

Electronic communications and records may be used for project approvals and business communications where applicable.

6. Client Responsibilities

The client is responsible for providing accurate and timely information required for the agreed service.

This may include:

• Business information
• Website content
• Logos and brand assets
• Images, videos and other media
• Product or service information
• Required account access
• Technical information
• Approvals and feedback
• Required documents
• Other project-specific information

The client is responsible for ensuring that information and materials supplied to Growth Tech are accurate and that the client has the necessary rights or permissions to provide and use such materials.

7. Client-Provided Content

Clients may provide text, photographs, videos, logos, trademarks, product information, customer information or other materials for use in a project.

The client represents that it has the necessary rights, permissions or authority to provide materials supplied to Growth Tech for the agreed purpose.

Growth Tech should not be treated as the owner of client-provided materials merely because those materials are used in a project.

8. Website Development

Website development is performed according to the agreed scope and technical requirements.

Depending on the project, website development may involve WordPress, Shopify, themes, plugins, applications, APIs, hosting environments, domain services, payment gateways and other third-party technologies.

Features dependent on third-party software or services may be affected by updates, compatibility issues, policy changes, outages or technical limitations outside the direct control of Growth Tech.

9. Domain, Hosting & Third-Party Services

Domain registration, hosting, premium themes, plugins, software licences, APIs, email services, payment gateways and other third-party services may be billed separately unless specifically included in the agreed quotation.

Third-party providers operate independently and may change their pricing, terms, features, technical requirements or availability.

Growth Tech is not responsible for third-party changes or failures to the extent they are outside Growth Tech's reasonable control.

10. Revisions & Changes

The number of revisions included in a project will depend on the applicable quotation or service agreement.

A revision means a reasonable modification to the agreed deliverable. New features, substantial redesigns, changes to approved requirements or work outside the original scope may be treated as additional work.

Where additional charges apply, Growth Tech may communicate the additional cost before undertaking the additional work.

11. Project Timelines

Estimated delivery timelines depend on project scope, client cooperation, content availability, approvals, technical dependencies and third-party services.

Client delays in providing content, information, approvals, access or feedback may result in corresponding changes to the expected delivery timeline.

A stated timeline should therefore be understood as an estimated project schedule unless a specific written deadline has been expressly agreed.

12. Payment Terms

Payment terms are determined by the applicable quotation, proposal, invoice or service agreement.

Depending on the project, Growth Tech may require an advance payment, milestone payment, monthly payment, recurring payment or full payment before delivery.

The client is responsible for making payments by the due dates specified in the applicable commercial documents.

13. Taxes & Third-Party Charges

Applicable taxes, including GST where applicable, may be charged in accordance with the relevant invoice and applicable law.

Third-party expenses such as domain registration, hosting, premium software, advertising spend, plugins, licences, APIs or other external charges may be separate from Growth Tech's professional service fees unless expressly stated otherwise.

14. Advertising & Marketing Budgets

Where paid advertising management is provided, the professional service fee and advertising/media budget may be separate amounts.

Advertising platforms independently determine campaign approval, auction results, delivery, availability, targeting limitations and other platform-related matters.

Growth Tech does not control the independent policies, algorithms, approval decisions or technical availability of third-party advertising platforms.

15. SEO & Performance Expectations

SEO and digital marketing performance can depend on many factors, including competition, industry conditions, website quality, search-engine algorithms, content, technical changes, budget, market conditions and actions taken by third parties.

16. Social Media & Platform Services

Social media and other platform-related services depend on third-party platforms that may independently change their policies, algorithms, features, account requirements, moderation systems or availability.

Growth Tech cannot guarantee continued availability of any specific platform feature or outcome controlled by a third-party platform.

17. Account Access & Security

Where a client provides access to a website, hosting account, social media profile, advertising account, analytics platform or other service, the client should provide appropriate access and maintain ownership of its accounts.

Clients should not provide unnecessary credentials or sensitive information.

Growth Tech may use access credentials only as reasonably necessary for the agreed service, subject to the applicable project or service arrangement.

18. Intellectual Property

Ownership and usage rights relating to website designs, code, graphics, content, source files, documents, creative materials and other deliverables depend on the agreed quotation, proposal, service agreement and payment status.

Unless specifically agreed otherwise, third-party themes, plugins, fonts, stock assets, software, APIs and other licensed materials remain subject to their respective licences and terms.

Client-provided trademarks, logos, photographs, content and other materials remain subject to the client's rights and applicable third-party rights.

19. Final Payment & Handover

Where a project includes final payment before handover, final files, credentials, administrative access, source materials or other agreed deliverables may be released after the applicable payment obligations have been satisfied.

The exact handover process depends on the project scope and agreed commercial terms.

20. Maintenance & Support

Website maintenance, updates, technical support, security monitoring and ongoing assistance are included only where expressly stated in the applicable service agreement or quotation.

A completed website project does not automatically include unlimited future development, maintenance or support.

21. Suspension of Services

Growth Tech may temporarily suspend work or services where reasonably necessary due to non-payment, missing information, lack of required access, abusive conduct, unlawful requests, security concerns or other material issues affecting the service relationship.

Where reasonably possible, Growth Tech may communicate the reason for suspension and the steps required to resume the service.

22. Prohibited Use

Clients must not knowingly request or use Growth Tech services for unlawful, fraudulent, deceptive, abusive, infringing or malicious activities.

This includes, where applicable:

• Fraudulent websites or deceptive schemes
• Phishing or credential theft
• Malware or malicious software
• Copyright or trademark infringement
• Illegal products or services
• Unlawful data collection
• Deceptive impersonation
• Activities prohibited by applicable law

23. Website Content & Legal Compliance

The client is responsible for ensuring that business claims, product information, pricing, legal statements, licences, regulatory disclosures and other client-provided content are accurate and legally appropriate.

Growth Tech may assist with website implementation and digital presentation, but the client remains responsible for the legality and accuracy of information relating to its own business, products and services unless a separate written arrangement expressly states otherwise.

24. Confidentiality

Growth Tech may receive confidential business information while providing professional services.

Such information may include business strategies, marketing plans, website information, project information, credentials, customer information and other non-public information.

Where specific confidentiality obligations are required, they may be documented through a separate confidentiality agreement, NDA or applicable service agreement.

25. Privacy & Data Protection

Personal information submitted through the Growth Tech website is handled according to our Privacy Policy.

Clients should also ensure that any personal data or customer information supplied to Growth Tech for a project is provided with appropriate authority and in accordance with applicable legal requirements.

26. Third-Party Services

Growth Tech may recommend, configure or work with third-party services where required for a project.

Examples may include hosting, domain providers, software, plugins, APIs, analytics systems, payment services, advertising platforms and social media platforms.

Third-party services are subject to their own terms, pricing, licences, technical limitations and policies.

27. Website Availability

We aim to keep the Growth Tech website available and functional, but continuous or uninterrupted availability cannot be guaranteed.

Temporary unavailability may occur because of maintenance, hosting problems, technical issues, security events, third-party failures or circumstances outside reasonable control.

28. No Professional Legal or Financial Advice

Clients should obtain advice from an appropriately qualified professional where specialist advice is required.

29. Limitation of Responsibility

Growth Tech will provide agreed services with reasonable professional care and according to the applicable scope.

However, Growth Tech cannot be responsible for events, losses or failures caused primarily by circumstances outside its reasonable control, including third-party platform changes, hosting outages, domain issues, client instructions, inaccurate client information, third-party software failures or other external dependencies.

30. Indemnification

To the extent permitted by applicable law, a client may be responsible for losses, claims or expenses arising from the client's unlawful use of services, infringement of third-party rights, unauthorised content, fraudulent instructions or violation of the applicable agreement.

Any indemnification obligation should be interpreted subject to applicable law and the specific client agreement.

31. Cancellation & Termination

Cancellation and termination of a service or project are subject to the applicable quotation, service agreement and Refund & Cancellation Policy.

Work already completed, third-party expenses, committed resources, delivered materials or other non-recoverable costs may be treated according to the agreed commercial terms and applicable law.

32. Changes to Services

Growth Tech may update, improve or discontinue particular website features, service offerings or methods of delivery from time to time.

Existing client projects will generally continue according to their applicable agreement, subject to necessary technical, legal or third-party changes.

33. Changes to These Terms

Growth Tech may update these Terms & Conditions from time to time to reflect changes in our services, business practices, technology or applicable legal requirements.

The updated version will be published on this page with a revised “Last Updated” date.

34. Governing Law

These Terms & Conditions are intended to be interpreted in accordance with the laws applicable in India, subject to any mandatory legal rights or requirements that may apply to a particular transaction or customer.

Where a specific written service agreement contains jurisdiction or dispute-resolution provisions, those provisions may apply to the relevant engagement.

35. Dispute Resolution

If a concern arises regarding a service, the parties are encouraged to first communicate in good faith and attempt to resolve the matter through direct discussion.

For a specific project, these website Terms may operate together with the applicable quotation, proposal, invoice, statement of work, service agreement or other written commercial document.

Where there is a conflict between general website terms and a specific written agreement for a project, the specific written agreement may govern the relevant project to the extent of the conflict.
